Our goal in these matters is to preserve and maximize a company’s value—usually by consensus but, where necessary, by litigation.

We have worked extensively on issues such as broker-dealer insolvencies, bank insolvencies, cross-border issues and the intersection between the Bankruptcy Code and derivatives, repurchase agreements and securities contracts.  We have also handled matters relating to mortgage-backed securities and collateralized debt obligations—experience that was critical during our representation of the liquidators of Bear Stearns High-Grade Structured Credit Strategies Master Fund, Ltd. and Bear Stearns High-Grade Structured Credit Strategies Enhanced Leverage Master Fund, Ltd., as well as in our representation of a $750 million creditor of the failed broker-dealer Refco Capital Markets, Inc., for whom we have recovered the fund’s entire claim and maintain a remaining interest in a litigation trust.

We are best known for our representation of formal and informal creditors committees, successfully bridging the interests of the various creditor constituencies in a restructuring, distress sale or liquidation.  Since 1999, we have represented creditors committees in more than 150 major restructurings. Among these were official creditors’ committees in such prominent financial restructurings as Delta Airlines, Calpine and WorldCom—the largest corporate Chapter 11 filing in history prior to the Lehman Brothers bankruptcy, in which we represent the ad hoc committee of bondholders.  Chambers USA (2008) calls our group “[a]n important force in the marketplace” and says we have “cornered the market in representing hedge funds and creditors’ committees,”  and “absolutely number one for creditors’ rights bar none.”
